These Terms of Service (“Terms”) govern your use of the SmileLumi website and any purchase of SmileLumi products. This Australia store is operated by ABYOU LLC, 500 4th St NW, Ste 102, Albuquerque, NM 87102-2104, USA (“we”, “us”). By using this site or placing an order, you agree to these Terms.

1. Who we are

2. The product

We sell a 3-in-1 oral care kit (brush, floss, tongue scraper) and related accessories as described on the product page. Photos and descriptions are provided in good faith. Colors and finishes may vary slightly from what you see on screen. SmileLumi products are for personal oral hygiene. They are not a substitute for professional dental care, diagnosis, or treatment.

3. Orders and pricing

Prices are shown in Australian dollars (AUD). Where GST applies, it is included in the displayed price or calculated at checkout as shown. We may change prices at any time; the price at checkout is the price that applies to your order. We may refuse or cancel an order if there is an obvious pricing or stock error, if we cannot verify payment, or if we reasonably suspect fraud.

Your order is accepted when we send an order confirmation email. Until then we may decline the order.

4. Payment

Payment is processed by Shopify and its payment partners. We do not store full payment-card numbers on our own servers. You represent that you are authorized to use the payment method you provide.

5. Shipping

Delivery times, destinations, and costs are described in our Shipping policy. Risk of loss passes to you when the carrier delivers to the address you gave us (or, if you refuse delivery without cause, when the carrier first attempted delivery).

6. Returns and the 30-day trial

You may try the kit for 30 days. If it is not right for you, you may return it for a refund as described in our Refund policy.

7. Use of the product

Use the kit only as described on the product page and any included instructions. Keep extra heads and small parts away from young children. Do not use a damaged handle or charger. Stop use and contact us (or a dental professional) if you have unusual pain, bleeding that does not settle, or a known allergy to silicone or the materials listed on the product page.

8. Intellectual property

SmileLumi names, logos, product photos, and site copy are owned by ABYOU LLC or used under license. You may not copy, scrape, or reuse them for commercial purposes without our written consent.

9. Privacy

How we collect and use personal information is described in our Privacy policy.

10. Disclaimer and limitation of liability

To the fullest extent permitted by law, the site and products are provided “as is.” We do not promise uninterrupted access to the site. Except for the 30-day trial and any non-waivable rights you have under applicable law (including the Australian Consumer Law), our total liability for a claim related to an order is limited to the amount you paid for that order. We are not liable for indirect, incidental, or consequential damages (lost profits, data, or goodwill) to the extent the law allows us to exclude them. Nothing in these Terms excludes, restricts, or modifies any consumer guarantee, right, or remedy under the Australian Consumer Law that cannot be excluded.

11. Governing law

These Terms are governed by the laws of the State of New Mexico, USA, without regard to conflict-of-law rules, except that any non-waivable consumer protections of your place of residence still apply — including, for Australian customers, the Australian Consumer Law. You and we will first try to resolve disputes informally by email at contact@smilelumi.com.

12. Changes

We may update these Terms. The “Last updated” date will change when we do. Continued use of the site after an update means you accept the revised Terms for future orders and visits.
